An Act to amend the Citizenship Act and the Immigration and Refugee Protection Act
Bill S-235 in 44-1 was a Senate Private Member's Bill amending the Citizenship Act (R.S.C. 1985, c. C-29) and the Immigration and Refugee Protection Act (S.C. 2001, c. 27) to address the first-generation cut-off rule for descent-based Canadian citizenship, the 44-1 precursor to 45-1 Bill C-3 (Citizenship Act amendments which received royal assent November 20, 2025 as S.C. 2025, c. 6). Brought in response to the Ontario Superior Court ruling in Bjorkquist v. Canada (2023 ONSC 7152) which found section 3(3) of the Citizenship Act unconstitutional under Charter sections 6 (mobility) and 15 (equality). Did not pass third reading in 44-1; the federal-government Bill C-3 in 45-1 delivered the substantive fix.
